An effectiveness model for the precautionary principle. Quantitative analysis of EU case law on GMOs (Genetically modified organisms)

The focus of this presentation is the precautionary principle, GMOs and the issues of risks associated with genetic engineering. The precautionary principle is a principle of EU law that allows safeguard measures to be adopted in case of uncertainty as to the existence of risk to health and the environment. EU regulation on GMOs heavily relies on the precautionary principle as a legal tool to restrict the deliberate release of GMOs on the territories of Member States.

In the presentation I will give an analysis on the legal cases on the adoption of safeguard clause and emergency measures and what level of risk they bring about.

The reason for the analysis is in legal aspects of risk regulation and adjudication, which opens possibilities to analyse legal aspects of risk in controlled conditions. Since scientific risk assessment provides for evidence that GM products pose no greater risk to health and environment than conventional products, the present analysis does not challenge scientific consensus on GMOs. Instead, it elaborates on new tools in risk research and data about the connection between the application of the precautionary principle to GMOs and uncertainty about risk.
